General Terms & Conditions
Parties
The Buyer: the person whose name appears on the Order Form and who is seeking to purchase goods and/or services.
The Seller: Elderberry Brides Ltd at 8 New Street, Basingstoke, Hants. RG21 7DE.
General
The Buyer's order is accepted on the basis that the following terms and conditions are to apply and will comprise the only terms and conditions to which the contract is subject.
1. ACCEPTANCE
It is the Buyer's responsibility to ensure that upon acceptance of the order it provides the Seller with all reasonable and sufficient information to enable the Seller to proceed with the order. This to include both delivery and e-mail addresses supplied correctly.
2. LIMITS OF CONTRACT
This acceptance includes only such goods and accessories as are specified herein this website and that all goods are subject to availability.
3. PRICES
All prices listed, quotes, order confirmation and invoices are in GB pounds Sterling and are subject to and include where appropriate VAT at the current rate of 20%.
4. PAYMENT
Payment is required on order.
5. DESPATCH
Where the Seller gives a date for delivery all such dates are approximate only. The Seller will use best endeavours to ensure that such dates are met, but is not responsible for any direct or indirect losses which may arise from failure to despatch or deliver within the time stated. In addition the seller shall not be responsible for failure to deliver or delays in delivery occasioned by causes beyond its control. Should despatch be delayed for any reason whatsoever a reasonable extension of time shall be granted and until such extension has expired the contract shall not be capable of cancellation by reason only of such delay.
6. VARIATION
No variation in the contract shall take place unless notified by the Seller in writing. No person, agent or representative of the Seller has any authority on its behalf of make orally any additional qualification or variation to the contract or of these conditions.
7. CANCELLATION / RETURNS
Distance Selling rules apply.
- On Standard length orders. You have the right to cancell the order within 7 days and receive a full refund.*
- On Rush cut orders that are time sensitive 24 hours are permitted to cancel the order for a full refund.
- The goods are made-to-order and, as such, all orders are accepted on a non-cancellable, no return basis.*
The only exception to this would be if there is a manufacturing fault. Note that:
- Ordering goods in an incorrect size does not constitute a manufacturing fault.
- Ordering goods in an unintended colour does not constitute a manufacturing fault.
It is the Buyer's responsibility to request the correct size(s) and colour(s) when ordering not the Sellers and for which the Seller will not be liable. All cancellations after payment are subject to an administration fee of £25.00
RETURNS
Should a manufacturing fault occur, we will endeavour to replace the returned item in a timely fashion or provide a full refund for the cost of the goods supplied. Please note this does not include postage and packaging.
8. WAIVER
Any waiver by the Seller of any breach of these conditions shall not be construed as a waiver of any other existing or future breach.
9. APPLICABLE LAW
This contract shall be subject to English Law and the jurisdiction of the English Courts.
10. SALE ITEMS
Sale items are sold as seen and non-returnable. No monies, once paid for the item(s) is refundable.
